The ad in question contains an unauthorized EAS song and was aired six times from October 20 to 24, 2023. Multiple complaints were filed on Oct. 20 about the TV spot. In its response to the investigation, the cable network acknowledged that it had used EAS warning signals in its advertising.
ESPN has the opportunity to respond to the proposed fine. The committee plans to examine all evidence and legal arguments regarding the alleged use of illegal tones before making a final decision on the matter.
This is the third time the network has misused the emergency tone on air. The FCC fined ESPN $1.12 million as part of a forfeiture order in 2015 when it used EAS tones on three cable networks a total of 13 times. ESPN was fined $20,000 in 2021 for violating its EAS tone usage rules for the second time during the broadcast of one of its 30 documentaries, “Roll Tide/War Eagle.”
